This Release, Waiver & Indemnification Agreement (“Agreement”) is for insurance purposes, to make certain that before
participating in school sponsored events, students are aware of the risks involved and who bears responsibility in case of personal injuries or damages incurred by the student or third parties. This Agreement governs the student’s participation in all field trips including, but not limited to, visits to museums, galleries, vernissages (preview or private art openings), artists’ studios, ateliers, shops, workshops and/or libraries; and Student Success activities including, but not limited to, parties and/or day and overnight trips or excursions (collectively referred to as “Event”).
Paris College of Art (“PCA”) is not responsible for the student’s actions during an Event or any resulting harm or damages. By signing this Agreement, the student is giving up his or her right and the right of his or her family members to sue or bring a lawsuit against PCA for any personal injuries, damages or losses that may occur in connection with his or her participation in an Event. The student also agrees to reimburse PCA if he or she is sued by a third party as a result of the student’s actions while participating in an Event.
I, (name of student), may participate in an Event while a student at PCA. I acknowledge that my participation in an Event is part of a scheduled class activity or voluntary. In consideration of PCA’s efforts in making the Event available and my being able to participate I, in turn, agree as follows:
I understand and acknowledge that there are certain dangers, hazards, and/or risks inherent in participating in Events, which could result in physical injuries (minimal, serious, or catastrophic) and/or property loss or damage. I further understand that I will have the opportunity and right to travel independently while studying at PCA and that participation in certain activities may cause me to face an increased risk of injury or death. I have signed this document in full recognition and appreciation of such dangers, hazards and risks, and acknowledge that I am solely responsible for my own safety.
I further understand and acknowledge that PCA does not represent nor act as an agent for, and cannot control the acts or omissions of any host family, transportation carrier, hotel, hostel, apartment agency, landlord, tour organizer of other provider of goods or services related to the Event in which I am participating.
I, individually and on behalf of my assigns, heirs, guardians, and representatives, agree to assume and accept all of the risks, dangers, hazards, and responsibilities resulting in or arising from my participation in the Event. I, individually and on behalf of my assigns, heirs, guardians, and representatives, hereby release and forever discharge PCA and its employees, agents, officers, trustees and representatives (in their official and individual capacities) from any and all liability, whatsoever for any and all damages, losses, harms, or injuries (including suffering and death) that I may sustain to my person or property or both, which arise out of, result from, occur during or are connected in any manner to my participation in the Event. I understand that this release covers liability, claims, actions, causes of action, damages, costs and expenses caused entirely or in part by any acts or failure to act including, but not limited to, negligence and carelessness by PCA or any of its employees, agents, officers, trustees and representatives (in their official and individual capacities).
I, individually, and on behalf of my assigns, heirs, guardians and representatives, hereby agree to indemnify, defend and hold harmless PCA and its employees, agents, officers, trustees and representatives (in their official and individual capacities) from any and all liability, losses, damages or expenses, including attorney’s fees, which arise out of, occur during, or are in any way connected with my participation in the Event and any related or independent travel.
I agree that as an enrolled student of PCA participating in a school sponsored Event, I am bound by all PCA rules and regulations regarding student conduct contained within the Student Handbook including, but not limited to, the Student Code of Conduct. I further understand that if I do not have a copy of the Student Handbook, a copy is available for my review on the mon.paris.edu portal.
This Agreement shall be construed in accordance with the laws of France.
